TERMS OF USE – Guest Wireless Internet Service

Access rules

1. You will NOT attach a computer connected to or associated with a Crimson Wine Group wireless access point simultaneously to any other network, wired or wireless, including Crimson Wine Group’s wired network.
2. You are responsible for protection of your computer from the inherent threats of the Internet.
   Crimson Wine Group is NOT responsible for damage to your computer, or corruption caused by malware or grayware infection while using Crimson Wine Group’s network services.
3. You understand that this service is provided AS-IS, with NO technical support. Crimson Wine Group personnel do not have access and are unable to provide technical assistance.
4. You will be sensitive to the fact that you are working in a public environment shared by people of all ages, and you agree to refrain from accessing content that others might reasonably deem offensive by community standards.
5. You will not view, display, or access information that violates federal, state, or local laws or regulations, including but not limited to those regarding obscenity or child pornography.
6. You acknowledge that accessing this service is a privilege that may be revoked at any time for any reason by Crimson Wine Group or its employees.
7. You will not hack, mishandle, damage, or attempt to damage computer equipment or software.
8. You will NOT use another person’s identification or address as your own to access the Internet, regardless of permission by that person.

Privacy

Crimson Wine Group cannot protect the privacy of communications transmitted over its open guest wireless Internet Service. No encryption is enabled by the wireless network, which means that anyone with the tools to do so could access your Internet communications. You are advised that anything you say or do on-line may be observed by a third party unless you otherwise undertake appropriate measures to use encrypted communications mechanisms.

Offensive Content

The Internet offers access to a wealth of material that is personally, professionally, and culturally enriching to individuals of all ages. However, it also enables access to some material that may be offensive, disturbing, illegal, inaccurate, or incomplete. Users of this Service are encouraged to evaluate the validity and appropriateness of information accessed via the Internet. Please be respectful of those around you and to Crimson Wine Group staff by refraining from attempting visit sites that others within view of your screen might reasonably deem objectionable.

Monitoring by Crimson Wine Group Support Staff

Crimson Wine Group monitors the usage of all the network services it provides to protect against threats to the confidentiality, availability and integrity of its critical information and services. This includes this Guest Internet Service. Crimson Wine Group does not routinely observe Guest Internet usage in real-time, nor does Crimson Wine Group collect such information for marketing and/or sales purposes. However, information transmitted via Crimson Wine Group network systems may be recorded without notice by intrusion detection systems, content filtering systems, and network troubleshooting systems. Where suspicious, malicious, or illegal activities are detected, Crimson Wine Group will cooperate with or provide such information to law enforcement, as appropriate. Crimson Wine Group reserves the right to monitor its network resources, including your use of this Service.

Crimson Wine Group may revise, amend, or restate this policy from time to time without notice by posting a new version of it on its logon banner, or on a web site linked on the logon banner.

NO WARRANTIES

THE SERVICE IS PROVIDED TO YOU “AS IS”. You assume the entire risk as to and acknowledge that you rely solely at your own risk on, the Service provided. Should the Service cause or contribute to causing harm to you in any way, you assume the entire cost of all servicing, repair or correction arising in connection with such harm.

LIMITATION OF LIABILITY

IN NO EVENT WILL CRIMSON WINE GROUP BE LIABLE FOR ANY LOST PROFITS, LOST BUSINESS, OR LOST DATA, OR FOR ANY CONSEQUENTIAL, INDIRECT, EXEMPLARY, PUNITIVE, SPECIAL, OR INCIDENTAL DAMAGES ARISING FROM OR RELATING TO THIS AGREEMENT OR THE SERVICE, INCLUDING WITHOUT LIMITATION DAMAGES THAT ARISE OUT OF YOUR USE OR INABILITY TO USE THE SERVICE (AND ANY INTELLECTUAL PROPERTY EXISTING THEREIN), EVEN IF CRIMSON WINE GROUP HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. “YOUR SOLE REMEDY FOR DISSATISFACTION WITH THE SERVICE IS TO STOP USING IT”.

INDEMNIFICATION

You agree to defend, indemnify, and hold Crimson Wine Group harmless from and against all loss, cost, liability, damage, and expense arising from or relating to your use or misuse of the Service or your breach of this Agreement, including without limitation all fines, penalties, liabilities, damages, costs, and expenses incurred by Crimson Wine Group because of your failure to comply with laws and regulations.
